The dispute stage

This stage implies that those debtor who have failed to favorably react during the amiable stage, namely have failed to comply with their payment commitments undertaken to our company, or have preferred to hide and not to react in any way to our interventions, under the customer written approval, shall be transferred to our company cooperating lawyers and legal advisers throughout the country in order to perform the procedural stage.

During this stage, due to the fact that our company has concluded working agreements with more than 250 lawyers and legal advisers throughout Romania, equally distributed in various counties and large cities, whose activity is strictly monitored, so that we are able to cover any area, we initiate legal proceedings under which we acquire writs of execution against such debtors, which shall be enforced by our forced execution department, and you will only be charged with the equivalent of legal stamp fees. More than 10 % of the cases are settled during the trials, because when the debtor sees that we are not joking and we initiate legal proceedings, it prefers to make the payment and close the case. Consequently, only less than 15 % of the cases require intervention during the forced execution stage but we also register outstanding results during such stage.

After obtaining the writ of execution, to the extent we only receive the file at such moment, we take parallel actions regarding: [a] negotiations with the debtors for an amiable payment of the debt that implies new court transactions; [b] the initiation of forced execution proceedings by means of the official receiver, which implies: [1] the identification of personal property and real estate held by the debtor with banks, insurance companies, leasing companies, local taxes and charges departments, land books, IT registrar offices; [2] pursuing the forced execution approval by the court regarding the claim filed by the official receiver; [3] defending our customer interests in potential challenging proceedings related to the forced execution or title, filed by the debtors; [4] monitoring the seizure and capitalization stage of the seized assets; During this stage, the customer shall bear all legal stamp fees, plus the amounts requested as down payment by the official receivers; Both during this stage and during our interventions, our company shall only charge the negotiated success fee, and only when the amounts of money shall be actually received by the customer, who will make the payment to us under the issued fiscal invoice, based on the actually received amount.

In case the debtor files challenging claims against the enforcement or title, our lawyers shall represent the customer, and the fees thereof shall be requested and awarded by the court, and followed and collected under the court resolution, directly from the debtor estate; during this stage, the customer shall only pay the legal stamp fees and the judicial fees required for the legal proceedings;

Any additional criminal or bankruptcy legal proceeding shall be filed under the same financial terms by our lawyers, namely at no cost for you, except for the legal stamp fees and related judicial stamps.
